Terms and Conditions
Super important that you read this and understand that with your registration you (the "Participant" acknowledges and confirms, that you have read and understand the information, representations, covenants, releases, waivers, and terms and conditions stated, and voluntarily give your permission to be bound by the terms and conditions and you are explicitly stating your agreement to the terms and conditions.
In registering, the Participant, hereinafter referred to as "Participant” agrees with the following terms and conditions set forth by REVmind Corp. hereinafter referred to as "Organizer," and the Participant is of sound mind to attend the event, hereinafter referred to as “the event”, and understands that the Participant bares all responsibility in attending the event.
The Participant agrees to be bound by the terms and conditions and that the Participant and their personal representatives, executors, heirs, family members, successors, and assignors, acknowledge, agree to, and represent the following:
1. Eligibility
a) Participants should be in good health and able to participate in the event activities.
b). Participant acknowledges that the event is a comprehensive process that may involve different areas of Participants life, including decision making processes, commitment, desires, work finances, health, relationship, education, recreation, and spirituality.
c) Participant agrees that deciding how to handle these issues, incorporate ideas, suggestions, principles into those areas and implementing choices is exclusively Participants responsibility.
2. Participant Responsibilities
a) Behavior
i. Participant is expected to behave respectfully and courteously to fellow participants, organizers, and event staff.
ii. Any behavior deemed disruptive or harmful may result in a dismissal from the event without refund.
iii. Organizer reserves the right to refuse admission at any time during the event, if it is perceived by the staff that Participant is under the influence of alcohol and/r illicit narcotics. Participant will be asked to leave, and Participant's registration will be revoked without refund.
iv. Organizer reserves the right to refuse admission if Organizer suspects or finds that Participant's behavior is causing a disturbance or others or jeopardizes the safety of others, the staff and/or the property. Participant will be asked to leave, and Participant's registration will be revoked without refund.
b) Health and Safety
i. Participant must disclose any medical conditions, allergies, or dietary restrictions to the Organizer in advance.
ii. Participant is responsible for their own health and safety during the event.
c) Confidentiality
Participant agrees to maintain the confidentiality of tother participants' personal information shared during the event.
3. Event Photography
Participant acknowledges that photographs and audio/video footage will be taken, and that their image and likeness may be used by the Organizer for marketing and publicity in publications, websites and in social media. By registering for this event, Participant:
a) grants and authorizes the Organizer and its subsidiaries and related entities, the right to take, edit, alter, copy, exhibit, publish, distribute and make use all pictures or video taken of you for marketing and publicity in publications, on websites and in social media;
b) waives all rights Participant may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee is charged;
c) waives any right to inspect or approve any photo, video, or audio recording taken by Organizer or the person or entity designated to do so by Organizer; and
d) hold harmless, and release the Organizer and the person or entity designated by the Organizer from all liability, petitions, and causes of action which Participant, heirs, representative, executors, administrators or any other persons may make while acting on Participant’s behalf or on behalf of Participant’s estate.
4. Diagnosis or Treatment of Mental Disorders
Participant acknowledges that the event does not involve the diagnosis or treatment of any mental disorders as defined by the American Psychiatric Association and that the event is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is your exclusive responsibility to seek such independent professional guidance as needed.
5. Therapy
a) The Participant understands that the event is not therapy and does not substitute for therapy, and does not prevent, cure, or treat any mental disorder or medical disease.
b) If the Participant is currently under the care of a mental health professional, it is recommended that the Participant promptly informs the mental health care provider of the nature and extent of the event and receive professional guidance if the Participant should attend.
6. Medical Treatment
a) In the event of a medical emergency, the Participant authorizes the Organizer to seek medical treatment on their behalf.
b) The Participant agrees to be responsible for any medical expenses incurred.
7. Assumption of Risk
a)The Participant assumes all risks associated with participation in the event, including but not limited to physical injury, emotional distress, or loss of personal property.
b) The Participant is solely responsible for creating and implementing their own physical, mental and emotional well-being, decisions, choices, actions and results arising the event. As such, the Participant agrees that the Organizer, any affiliates, executives, coaches, subcontractors and the location and location owners are not and cannot be held liable or responsible for any actions or inaction, or for any direct or indirect result of the event and/or any services provided.
c) The Participant understands there is a certain level of risk associated with any event and subsequent participation, and body responses to these various activities cannot be predicted with complete accuracy. The Participant understands the risk of negative body response to their participation. The Participant HEREBY ACKNOWLEDGES AND ASSUMES THE RISKS OF PARTICIPATION.
d) The Participant agrees that they are responsible for any resulting personal injury and damage to or loss of property arising out of their participation, including personal injury and damage to or loss of property of another registrant, and the Participant agrees that they are solely responsible for any medical costs and expenses arising therefrom.
e) The Participant acknowledges and agrees that it is their responsibility to determine whether they are sufficiently fit and healthy enough to safely participate in the event without reservations.
8. Release of Liability
a) The Participant releases the Organizer, including its affiliates, officers, employees, contractors, agents, and successors from any liability for any injury, loss, or damage that may occur during the event.
b) The Participant voluntarily participates in any, and all of the ongoing activities sponsored by the Organizer, including, but not limited to, breathwork, sitting meditations, walking meditations, energy sessions, lectures and any other activities at the event.
c) The Participate understands that participation may include ongoing silent and vocal, intense activities and may experience unusual psychological, emotional, and/or physical states of mind and body arising from participation. The Participant is voluntarily participating in such activities with knowledge of the potential of unusual events.
d) The Participant understands their participation and execution of this Waiver is voluntary.
e) The Participant has read and fully understands the terms of this Participation Waiver, intending to be legally bound by its terms.
f) The Participant agrees to consult their physician and obtain written medical clearance, if required, due to a serious health condition prior to their participation. If a physician consultation is not required, the Participant declares to be in adequate physical and psychological shape for participation and is not aware of any medical condition or symptoms that would prevent them from participation. The Participant understands that participation is not a substitute for traditional medical treatment and will consult their physician or other appropriate health care professionals.
g) The Participant certifies that they have not been advised against participation by a qualified medical doctor or professional.
h) The Participant understands that the Organizer nor its staff are responsible for the Participant in any manner during the event or while outside of the designated event area.
i) The Participant agrees that the Organizer, including its affiliates, officers, employees, contractors, agents, and successors does not dispense emergency medical services, medical advice, or prescribe the use of any participation as a form of treatment for any mental, physical, or medical problems, either directly or indirectly.
j) The Participant understands that the feedback and opinions presented to them should be taken as such. It is the Participant’s duty and responsibility regarding the choices and decisions they make.
k) The Participant understands that the Organizer will take no responsibility for health risks during their participation.
l) The Participant assumes the risk of physical injury, illness, or death and agree that their participation shall be at all times at their own risk.
m) THE PARTICIPANT ON BEHALF OF THEMSELF AND THEIR PERSONAL REPRESENTATIVES, EXECUTORS, HEIRS, FAMILY MEMBERS, SUCCESSORS, AND ASSIGNS, HEREBY KNOWINGLY AND VOLUNTARILY COVENANT NOT TO SUE AND AGREE TO WAIVE, RELEASE AND DISCHARGE AND COVENANT NOT TO SUE the Organizer and all of its Representatives from any liability, loss, cost, damage, expense, claim, or suit whatsoever for any and all injury, loss, illness, death, harm, cost, expense, claim, suit, or damage related to the Participant’s participation, including any negligent acts or conduct by the Organizer and its Representatives (collectively “Claims”).
n) The Participant further agrees to indemnify and hold harmless the Organizer and its Representatives from and against any and all third-party Claims associated with their participation.
9. Severability
a) If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.
b) If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
10. Applicable Law
This Agreement shall be governed and construed in accordance with the laws of the state of Massachusetts without giving effect to any conflicts of law's provisions.
11. Binding Effect
This Agreement shall be binding upon the parties hereto and their respective successors and permissible assigns.
In registering, the terms and conditions, the Participant acknowledges and confirms, that they have read and understand the terms and conditions and all information, representations, covenants, releases, waivers, and terms and conditions stated above, and voluntarily give their permission to be bound by the terms and conditions and the Participant is explicitly stating their agreement to the above terms and conditions.
